Zwald Travel Planner CO., LTD. carries out a professional activity of designing, organising and selling travel, in accordance with its registered activity and, where applicable, with the authorisations and licences that apply to it.
2. Purpose and scope
These terms and conditions govern all services offered by the company: support in preparing a tailor-made trip, organised group trips (Girls Trips), individual advice calls, gift cards and digital guides.
Each service has its own specific terms, set out in article 5. Unless stated otherwise, the general provisions of these terms apply to all services.
Some services offered by the company under other trading names are governed by their own booking terms.
3. Nature of the services
The company offers in particular:
- personalised itineraries and digital travel journals
- recommendations for accommodation, activities and transport, depending on the chosen package
- practical advice based on first-hand experience of living locally
- introductions to local providers at the client's request
- small-group trips on set dates, with limited places
- individual advice calls of a set length
- digital content (guides) delivered after payment
4. Ordering, booking and confirmation
For tailor-made trip support, the service starts once the quote has been accepted and the deposit set out in article 5.1 has been paid.
For a group trip (Girls Trips), pre-registration is free and non-binding. The client receives the dates, the programme and the places available. The booking only becomes final once the company has confirmed the departure and the corresponding deposit has been paid.
For an advice call, the booking is made directly with the company (WhatsApp or any other channel shown on the website) and becomes effective once the full amount has been paid, before the call takes place.
For a digital guide, the order becomes effective once paid in full. Access is sent electronically within a reasonable time.
For a gift card, the order becomes effective once the amount chosen by the client has been paid in full.
In all cases, confirming an order means fully accepting these terms and conditions.
5. Prices and payment
The prices for each service are shown on the company's website or given in the quote sent to the client. The company may change its prices at any time; the price that applies is the one in force when the order is placed. Prices shown in a currency other than the Swiss franc (CHF), the reference currency, are given for information and may differ slightly from the exchange rate actually applied.
5.1 Tailor-made trip support
A deposit of half of the total price is required when the quote is signed. The quote is valid for ten days from the date it is issued; after that, the price may be revised.
The deposit is non-refundable, unless the law provides otherwise. No work starts before the deposit is received.
The balance is due when the final digital travel journal is delivered.
5.2 Girls Trips
Pre-registration is free and non-binding.
A departure is confirmed when the minimum number of participants announced for that date is reached. If it is not reached, the company informs the registered participants and either refunds all amounts already paid in full or offers to move to another date, at the participant's choice.
Once the departure is confirmed, a deposit is required to secure the place. This deposit is non-refundable if the participant withdraws, unless the law provides otherwise. As places are limited, confirmations are made in order of registration.
5.3 Advice call
The advice call is paid in full when booked. The amount paid can be deducted from the price of a full support package if the client signs up within thirty days after the call.
The client may reschedule the call free of charge up to twenty-four hours before the agreed time. After that, or if the client does not attend the call, the amount paid is kept by the company.
5.4 Gift cards
A gift card is valid for twelve months from the date of purchase. After that, it is no longer valid, unless the company expressly agrees otherwise.
It can be used for any service offered by the company, up to the amount credited. It cannot be refunded or exchanged for cash, but it can be transferred to another person at the buyer's simple request.
5.5 Digital guides
Guides are offered on a pay-what-you-want basis. A guide is sent electronically once payment has been received, whatever the amount, and is non-refundable once sent.
5.6 Payment methods
Payments are made by bank transfer or via Wise. Other payment methods may be agreed with the client. Any bank charges or payment platform fees are paid by the client.
6. Travel documents and formalities
The client alone is responsible for the validity of their travel documents (passport, visa), their vaccinations and for meeting the entry and stay requirements of their destination.
The company may give general information for guidance, but cannot be held responsible for a refused entry, a missing formality or any consequence of a non-compliant document.
7. Liability
The company undertakes to give advice based on its experience on the ground and on reliable sources. However, it cannot be held responsible for:
- price changes or cancellations decided by a third-party provider
- weather conditions
- decisions of local authorities or travel restrictions
- difficulties encountered by the client on site, as long as they are not caused by a fault of the company
- the consequences of a non-compliant travel document (see article 6)
The client alone is responsible for any bookings they make themselves outside the company's services, and for taking out insurance suited to their trip (see article 9).
The client is responsible for the accuracy of the information they provide (dates, number and age of travellers, health or mobility constraints, preferences). The company cannot be held responsible for an unsuitable recommendation resulting from inaccurate or incomplete information.
Prices, schedules and availability of third-party providers mentioned in an itinerary are given for information, as of the date the itinerary is delivered. They may change afterwards without the company being liable.
To the extent permitted by law, the company's total liability, for any cause, is limited to the amount actually paid by the client for the service concerned.
8. Force majeure and exceptional circumstances
The company cannot be held responsible for failing to perform or for changing a service in the event of force majeure or of exceptional circumstances beyond its reasonable control.
These include in particular, without this list being exhaustive:
- armed conflicts, attacks and political instability
- airspace closures or government restrictions
- natural disasters (earthquakes, tsunamis, floods, storms, volcanic eruptions)
- epidemics or pandemics
- administrative decisions affecting travel
- major transport strikes
As the advice service is carried out before the trip and does not depend on the services the client books with third parties, amounts paid for itinerary design or advice are kept by the company if such an event occurs.
9. Travel insurance
The company strongly recommends that the client takes out, before departure, travel insurance covering in particular:
- trip cancellation or changes
- trip interruption
- medical assistance and repatriation
- personal liability abroad
- exceptional or unforeseen events
The company is not authorised to recommend a specific insurance policy, as this depends on the client's personal situation and on the type of trip. The client must check the extent of their cover before departure.
10. Complaints
Any complaint about a service provided directly by the company must be sent via the website's contact page within thirty days after the end of the service concerned, or within eight days after receiving digital content in the case of a clerical error.
Any complaint about a third-party provider (accommodation, transport, activity, insurance) must be sent directly to that provider, following its own procedure and deadlines. The company may help the client with this as a courtesy, without taking on the provider's contractual liability.
11. Right of withdrawal
In line with the exceptions provided for by the rules on distance selling of fully performed services or digital content, the client acknowledges and accepts that the right of withdrawal does not apply once they have expressly asked for the service to start before the end of the legal period, in particular for: tailor-made support started on receipt of the deposit, an advice call already held, a guide already sent, a gift card already issued, or a group trip tied to set dates.
By confirming their order and the related payment, the client expressly asks for the service to start immediately and acknowledges losing their right of withdrawal to that extent.
12. Use of client feedback and visual content
With the client's consent, the company may use testimonials, reviews or photos sent by the client to present its services on its website and social media.
Only the client's first name or initials are shown, unless the client asks otherwise. The client may ask at any time for content about them to be removed, by sending a request via the website's contact page.
13. Changes and cancellation by the client
Any request to change an order once confirmed (dates, package, content) is reviewed by the company case by case and may lead to extra charges if it involves additional work.
Any cancellation by the client is subject to the non-refundable deposit rules set out in article 5, unless the law provides otherwise.
14. Intellectual property
The itineraries, digital travel journals, personalised documents, materials and recommendations provided by the company are original works protected by intellectual property law.
These documents are strictly for the client's personal use. Any reproduction, distribution, sharing with third parties, resale, publication or commercial use, in whole or in part, is forbidden without the company's prior written permission.
The client undertakes to respect the confidential and personal nature of the documents provided. Any misuse may lead to legal action under the applicable intellectual property rules.
15. Personal data
The company processes the client's personal data in line with the principles of the General Data Protection Regulation (GDPR), which applies to clients living in the European Union.
Details of the data collected, who receives it, how long it is kept and the client's rights are set out in the company's privacy policy (in French).
16. Disputes
The parties undertake to look for an amicable solution in the event of a disagreement about these terms.
These terms and conditions are governed by Thai law. If a dispute cannot be settled amicably, the competent courts are those of the company's registered office, unless mandatory rules that apply to the client provide otherwise.
17. Independence of the parties
The company carries out a professional activity of designing, organising and selling travel. It has no exclusivity agreement with any third-party provider (accommodation, transport companies, activities): its recommendations are made impartially.
There is no personal contractual relationship between the client and the individuals working for the company; they act in the name and on behalf of Zwald Travel Planner CO., LTD.
18. Acceptance of the terms
The client confirms having read these terms and conditions before confirming their order, whatever the service.
Signing the quote, accepting a confirmed pre-registration or paying an amount due means fully accepting these terms.
19. Other provisions
The company may change these terms at any time. The terms that apply are those in force on the date of the order.
If any clause of these terms were found to be invalid or unenforceable, the other clauses would remain fully in force.
Written exchanges with the company, including on WhatsApp, are binding between the parties.
